Please read these terms carefully before using DeepSight. They govern your access to and use of our detection platform, API, and related services.

Acceptance of Terms

By accessing or using DeepSight's website, API, or any related services (collectively, the “Service”), you agree to be bound by these Terms of Service (“Terms”). If you are using the Service on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms.

If you do not agree to these Terms, you must discontinue use of the Service immediately. Your continued access to or use of the Service following any changes to these Terms constitutes acceptance of those changes.

Description of Service

DeepSight provides AI image detection and analysis tools designed to help users assess whether an image may have been generated or manipulated by artificial intelligence. The Service includes, but is not limited to, our web-based detector tool, API endpoints, forensic reporting features, and related documentation.

The Service analyzes images across multiple dimensions—spectral, frequency, and structural—to identify patterns consistent with synthetic generation. Results include confidence scores, verdicts, and where possible, identification of the source generator.

Important Disclaimer on Detection Accuracy

DeepSight's analysis is probabilistic, not definitive. Detection results represent a statistical assessment based on known synthetic patterns and should be treated as one data point among many—never as conclusive proof. No detection technology can guarantee 100% accuracy, and results may vary depending on image quality, format, compression, and the generation method used.

You acknowledge and agree that DeepSight's outputs are informational in nature. They should not be used as the sole basis for legal proceedings, employment decisions, content moderation policies, academic integrity judgments, or any action that could materially affect an individual or organization without independent verification.

We continuously improve our models, but the landscape of AI-generated imagery evolves rapidly. New generation techniques may produce images that our current models do not detect. We make no guarantee that the Service will identify all AI-generated content.

User Obligations

When using the Service, you agree to the following obligations and restrictions:

  • a.No illegal use. You shall not use the Service for any purpose that violates applicable local, state, national, or international law or regulation. This includes, but is not limited to, using detection results to facilitate fraud, harassment, defamation, or discrimination.
  • b.No circumventing detection. You shall not use the Service, its outputs, or any information derived from it to develop, train, or improve tools or techniques designed to evade AI image detection—whether by DeepSight or any other detection system. This includes using our analysis to iteratively refine AI-generated images until they pass detection.
  • c.No reverse engineering. You shall not attempt to reverse engineer, decompile, disassemble, or otherwise derive the source code, algorithms, model weights, or underlying architecture of the Service. This restriction applies to the detection engine, API, scoring methodology, and any proprietary technology used by DeepSight.
  • d.Responsible disclosure. You agree not to publicly misrepresent DeepSight's results or present them as definitive proof of an image's authenticity or inauthenticity. When sharing results, you must clearly communicate the probabilistic nature of the analysis.
  • e.No abuse of service. You shall not engage in any activity that disrupts, degrades, or interferes with the Service's infrastructure, including but not limited to denial-of-service attacks, automated scraping beyond authorized API usage, or exploitation of system vulnerabilities.

Intellectual Property

All intellectual property rights in and to the Service—including but not limited to software, algorithms, models, documentation, branding, and design—are and shall remain the exclusive property of DeepSight and its licensors. These Terms do not grant you any right, title, or interest in the Service beyond a limited, non-exclusive, non-transferable, revocable license to use the Service in accordance with these Terms.

You retain ownership of the images you upload for analysis. DeepSight does not claim any intellectual property rights over user-submitted content. Uploaded images are processed for analysis purposes only and are handled in accordance with our Privacy Policy.

The DeepSight name, logo, and all related marks are trademarks of DeepSight. You may not use these marks without prior written permission, except as necessary to accurately reference the Service in editorial or academic contexts.

API Usage Terms

Access to DeepSight's API is governed by these Terms and any additional terms specified in your API subscription agreement. By using the API, you agree to the following:

  • a.Rate limits. You must respect the rate limits associated with your subscription tier. Exceeding rate limits may result in throttling, suspension, or termination of API access.
  • b.API keys. Your API keys are confidential. You are responsible for safeguarding your keys and for any activity conducted under your account. You must notify us immediately if you suspect unauthorized use of your API credentials.
  • c.Fair use. API access is intended for legitimate image analysis workflows. Bulk automated requests designed to map our detection capabilities, benchmark against competing services, or build derivative products are prohibited without explicit written authorization.
  • d.Service availability. We strive for high uptime but do not guarantee uninterrupted API access. Scheduled maintenance, infrastructure updates, and unforeseen incidents may temporarily affect availability. We will make reasonable efforts to provide advance notice of planned downtime.

Account Terms

Certain features of the Service require you to create an account. When you register, you agree to provide accurate, current, and complete information. You are responsible for maintaining the security of your account credentials and for all activities that occur under your account.

You must be at least 16 years of age to create an account and use the Service. If you are under 18, you represent that you have obtained consent from a parent or legal guardian.

One person or entity may not maintain more than one free account. We reserve the right to remove or reclaim accounts that are inactive, violate these Terms, or were created in bad faith, including accounts registered with misleading information.

Disclaimer of Warranties

The Service is provided on an “as is” and “as available” basis, without warranties of any kind, whether express, implied, statutory, or otherwise. To the fullest extent permitted by applicable law, DeepSight disclaims all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, non-infringement, and accuracy.

We do not warrant that the Service will be uninterrupted, secure, or error-free, that results will be accurate or reliable, or that any defects will be corrected. You use the Service at your own risk and discretion.

No advice or information, whether oral or written, obtained from DeepSight or through the Service shall create any warranty not expressly stated in these Terms.

Limitation of Liability

To the maximum extent permitted by applicable law, DeepSight and its officers, directors, employees, agents, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill, whether in an action of contract, tort, or otherwise, arising out of or in connection with your use of the Service.

In no event shall DeepSight's total aggregate liability to you for all claims arising out of or relating to these Terms or the Service exceed the greater of (a) the amounts you have paid to DeepSight in the twelve months preceding the claim, or (b) one hundred U.S. dollars ($100).

This limitation applies regardless of whether DeepSight has been advised of the possibility of such damages and regardless of the failure of any essential purpose of any limited remedy.

Termination

We reserve the right to suspend or terminate your access to the Service at any time, with or without cause, and with or without notice. Grounds for termination include, but are not limited to: violation of these Terms, conduct that we reasonably believe is harmful to other users or to DeepSight, or extended periods of account inactivity.

You may terminate your account at any time by contacting us or through your account settings. Upon termination, your right to use the Service ceases immediately. Any provisions of these Terms that by their nature should survive termination shall survive, including but not limited to intellectual property provisions, disclaimers, indemnification, and limitations of liability.

For paid subscriptions, termination does not automatically entitle you to a refund. Refund eligibility is determined by the terms of your specific subscription plan and applicable law.

Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of laws provisions.

Any dispute arising out of or relating to these Terms or the Service shall first be attempted to be resolved through good-faith negotiation. If the dispute cannot be resolved through negotiation within thirty (30) days, either party may submit the dispute to binding arbitration administered by the American Arbitration Association under its Commercial Arbitration Rules.

You agree that any dispute resolution proceedings will be conducted on an individual basis and not as a class, consolidated, or representative action. You waive any right to participate in a class action lawsuit or class-wide arbitration against DeepSight.

Changes to Terms

We reserve the right to modify these Terms at any time. When we make material changes, we will notify you by updating the “Last updated” date at the top of this page and, where appropriate, through in-product notifications or email.

Material changes will take effect no sooner than thirty (30) days after the updated Terms are posted. Non-material changes, such as clarifications or formatting adjustments, take effect immediately. Your continued use of the Service after changes become effective constitutes acceptance of the revised Terms.

We encourage you to review these Terms periodically. If you disagree with any changes, your sole remedy is to discontinue use of the Service.
